Terms of Service and Subscription Agreement

These Terms of Service and Subscription Agreement ("Terms") are an agreement between you, the agent or agency subscribing ("you"), and the owner and operator of MedaBooking.ai ("MedaBooking.ai", "we", "us"). By starting a trial, paying for a package or using MedaBooking.ai, you agree to these Terms.
1. What MedaBooking.ai is
MedaBooking.ai is software that connects to your own PitchPrfct, Cal.com and related accounts to read and answer text messages, book appointments, protect your texting number and show your pipeline in the MedaBooking.ai Colony. MedaBooking.ai is not an insurance company, agency, broker or producer. It does not sell, quote, recommend or bind insurance, and it does not give insurance, legal or tax advice.
2. Your license
While your subscription is active and paid, we grant you a limited, non-exclusive, non-transferable license to use MedaBooking.ai and the MedaBooking.ai Colony extension for your own insurance business, under the package you pay for. You may not resell, sublicense, copy, reverse engineer or share MedaBooking.ai, your access code or the Platinum playbook with anyone outside your business.
3. Your accounts and your responsibilities
- You must have your own PitchPrfct account with a registered texting number (A2P 10DLC), your own Cal.com account and any other accounts MedaBooking.ai connects to, and you pay those companies directly.
- You are solely responsible for having the legal consent required to text every contact, for honoring opt-outs and do-not-call requests, and for complying with the Telephone Consumer Protection Act, the Florida Telephone Solicitation Act and other state telemarketing laws, CMS Medicare marketing rules, carrier and FMO rules, and the terms of PitchPrfct and Cal.com.
- Lead collection (Platinum) gathers business contact information from public sources and checks it against Do Not Call and litigator lists. These checks reduce risk but do not create consent. You decide whether and how to contact these leads, and you are responsible for doing so lawfully.
- You must hold every insurance license required where you do business. You are responsible for every message sent from your account, including messages MedaBooking.ai sends using the templates and settings you choose.
- You will review and approve the wording MedaBooking.ai uses, including any price ranges. MedaBooking.ai is designed to hand Medicare, Medicaid and complex questions to you, and you agree to answer those yourself.
4. Packages, trial and billing
- Packages are Guard, Closer and Platinum, billed monthly in advance at the prices shown on our website. Features are unlocked by package.
- Free trial: 7 days, card required, one trial per agent. Unless you cancel before the trial ends, your card is charged for the first month on day 8.
- Payments are processed by Stripe. If a payment fails, we retry it and notify you. After 7 days unpaid, your account is paused: MedaBooking.ai stops replying and booking, but opt-out handling continues until the account is closed. Paying the balance restores service.
- You may cancel anytime from your account. Cancellation takes effect at the end of the paid month. Fees already paid are not refunded, except where the law requires.
- Referral credits: a new agent using a referral code receives 50% off their first paid month, and the referring agent receives 50% off their next monthly payment after the new agent's first payment succeeds. Credits have no cash value and may be withdrawn for abuse.
- We may change prices with at least 30 days' notice by email. The new price applies from your next billing period.
5. Acceptable use
You may not use MedaBooking.ai to text people without consent, to text purchased or rented lists without proper opt-in, to send harassing, deceptive or unlawful messages, to impersonate others, or to interfere with MedaBooking.ai or other agents' accounts. We may suspend your account immediately if we reasonably believe you are doing so.
6. Your data
Your leads and client information belong to you. We process them only to provide MedaBooking.ai to you, as described in our Privacy Policy. Each agent's data is kept separate, and no other agent can see it. After cancellation we keep your data for 30 days so you can come back or export it, and then we delete it, except where the law requires us to keep it.
7. AI and automation
MedaBooking.ai uses automated rules and AI services to read and answer messages. Automated replies can be wrong. You are responsible for monitoring your account, reviewing "Needs you" alerts and correcting any message. MedaBooking.ai does not guarantee any number of replies, bookings or sales.
8. Third-party services
MedaBooking.ai depends on services we do not control, including PitchPrfct, Cal.com, mobile carriers, Google, Stripe and our hosting providers. We are not responsible for their outages, changes, fees or decisions, including blocked or filtered messages.
9. Disclaimers
MedaBooking.ai is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost commissions or lost data. Our total liability for any claim related to MedaBooking.ai is limited to the amount you paid us in the 3 months before the claim.
11. Indemnity
You agree to defend and indemnify us against claims, fines and costs arising from the messages sent from your account, your lack of consent to contact any person, your violation of law or carrier rules, or your breach of these Terms.
12. Changes and termination
We may update these Terms and will notify you of material changes by email or in the Colony. Either of us may end the subscription as described above. Sections 3, 6, 9, 10, 11 and 13 survive termination.
13. Law and disputes
These Terms are governed by the laws of the State of Florida. Any dispute will be resolved in the state or federal courts located in Miami-Dade County, Florida.
